Refund policy
Version 1.2, 21 September 2026. This policy forms part of the terms of sale.
- The free game and documentation help you assess the engine. Private source code is available after purchase.
- We do not offer a voluntary change-of-mind refund after digital delivery begins. Mandatory consumer rights and applicable Link buyer protection remain available.
- A pending payment dispute may suspend repository access. It does not itself end the licence or require you to stop using received versions.
- A full refund or final adverse payment reversal ends the licence prospectively, subject to mandatory rights and any express written exception. A partial refund alone does not.
- A refunded duplicate purchase does not cancel another valid licence.
- A purchase billed from outside the sales countries in terms section 4.5 is declined and refunded in full automatically. No licence or access is granted.
1. Evaluation before purchase
The game demonstrates the engine running in a browser, and the public docs describe its use. They do not expose the private source or every feature, limitation or suitability for your project. Checkout records that you had the opportunity to evaluate these public materials, not that you tested everything or accepted an undisclosed defect.
2. Voluntary change-of-mind refunds
After digital delivery begins, we do not offer a voluntary refund merely because you no longer need the engine or prefer another product. This policy does not exclude an available statutory withdrawal right or a remedy where the source is not supplied or fails to conform to the contract, including its descriptions of functionality and compatibility.
3. Statutory withdrawal
Consumers in the European Union, EEA and United Kingdom normally have a 14-day withdrawal or cancellation period for an online digital-content purchase. The applicable rules determine when that period starts, any extension for missing information, and when the right can be lost.
For immediate digital supply, we request your express consent to supply during that period and your acknowledgement of the resulting loss of the withdrawal right. We send the purchase-time documents and those confirmations by email. We rely on the loss of that right only where the applicable legal requirements, including actual commencement of supply and required confirmation, have been met. Payment, a checkbox or a sent invitation alone does not establish every requirement. A missing confirmation or delivery problem requires review; it is not an automatic refusal of your claim.
The EU rules include Articles 8(7), 14(4)(b) and 16(m) of the Consumer Rights Directive. The UK rules include regulations 16 and 37 of the Consumer Contracts Regulations. Mandatory local rules prevail.
You can use Withdraw from contract, also linked from the site footer and your account. Enter your name, details identifying the purchase and an email address for the acknowledgement, review the statement, then select Confirm withdrawal. No sign-in or reason is required. We record the statement and its submission time, show a receipt you can save and send an acknowledgement by email. An email delay does not change that time. The acknowledgement confirms receipt of the statement; eligibility and any reimbursement are reviewed separately under the applicable rules.
You can instead send a clear statement of withdrawal to support@pinionfall.com, identifying your name and purchase, or contact Link using the details on your receipt. You need not contact us before using another available remedy. Sending your statement before the applicable deadline is sufficient. We will acknowledge and process an eligible withdrawal without undue delay, with reimbursement within the applicable statutory period, normally 14 days after notice, using the original payment method unless you expressly agree otherwise without a fee.
You may use this optional statement, but it is not required:
To Pinionfall, support@pinionfall.com (postal address in the imprint): I withdraw from my contract for the Pinionfall Engine source licence. Ordered on: [date]. Order reference: [reference]. Name and address: [your details]. Date: [date]. Signature: [only if sent on paper].
Swiss law does not provide a general withdrawal right for online purchases. Buyers acting for a trade, business or profession generally do not have the consumer withdrawal right. Neither statement limits another mandatory right that applies to your purchase.
4. Non-delivery and defects
Mandatory rights where digital content is not supplied or does not conform to the contract remain available. Depending on the applicable law and circumstances, these may include supply, correction, a price reduction or termination and reimbursement. An evaluation opportunity does not waive them. Contact support@pinionfall.com with the problem so we can investigate; doing so does not postpone a legal or provider deadline.
5. Link buyer protection
Link acts as merchant of record for the purchase. Its Sold through Link refund policy applies independently of our voluntary policy. It provides a claim route within 60 days for specified problems, including non-receipt, significant misdescription, defects, unauthorised payments and duplicates, subject to its eligibility conditions. Its policy does not provide general change-of-mind coverage. These provider limits do not shorten mandatory statutory rights.
We respond to payment claims using relevant purchase and delivery records. Recorded invitations, acceptance and provider submission of email are distinguished from a source download or receipt of that email. The evidence is reviewed against the actual claim; an invitation alone does not disprove a delivery problem.
6. Delivery help
If your GitHub invitation is missing, expired or unusable, write to support@pinionfall.com. Invitations normally expire after 7 days; automatic retries and account-page resends are described in terms section 8.2. We will investigate and fix access promptly. You may contact Link or your payment provider directly; support contact is not a prerequisite to a refund, withdrawal or dispute.
7. Duplicates and partial refunds
We refund accidental duplicate purchases for the same licensed entity. Only the duplicate licence record ends; another valid licence continues.
A partial refund, including a goodwill adjustment or statutory price reduction, does not itself end the licence. Cumulative refunds returning the whole price are a full refund. A partial refund does not clear a separate unresolved dispute or termination for material breach. An express written agreement to preserve a licence after a refund governs that exception and its access arrangements.
8. Access and licence rights
The licence, sections 15 to 18, sets out these consequences:
| Event | Repository access and rights |
|---|---|
| Pending dispute or conflicting provider outcomes | Access may be temporarily suspended. Received versions and permitted products remain licensed during the suspension. You can request human review. |
| Dispute resolved without adverse reversal | Access is restored promptly once the provider confirms the outcome and no other restriction remains, including access to versions published in the meantime. |
| Partial refund alone | Licence and access continue, unless cumulative refunds return the whole price. |
| Full refund or final adverse chargeback or reversal | The licence ends prospectively, subject to mandatory law and any express written exception. Repository access ends. |
| Duplicate refunded | Only the duplicate record is affected. Another valid licence continues. |
Opening a dispute is not itself a breach and does not require deleting your copies or withdrawing your products. Actual termination ends future engine use and new distribution, with removal, deletion and permitted retention as set out in licence section 17. It does not make earlier permitted use infringing or require recall of end-user copies lawfully supplied before termination. Separately licensed third-party components and your original work retain their own rights.
If we recorded a reversal or termination in error, we investigate and correct the rights and access record under licence sections 15.3 and 17.7. If distribution ends on our side, received versions remain licensed under section 18.
9. Purchases from outside the sales countries
We currently sell only to customers located in the countries and territories listed in terms section 4.5. If the billing address given at checkout is outside that list, or none is reported to us, we decline the order and refund the payment in full automatically to the original payment method. No licence is granted and no repository access is given. We send a short notice by email; nothing needs to be requested.
